TICKETS: Ticket prices are set at $55 for each ticket. There is no maximum number of tickets allowed per person. The random drawing will take place on Monday April 24, 2017. Only 999 tickets will be sold. All ticket sales benefit Spartanburg Philharmonic Orchestra (SPO), and are NOT tax deductible. Tickets can be sold to employees, Board Members and other affiliated persons. You need not be present to win. If 499 tickets are not sold, a full refund will be provided and the raffle will not occur. The Music Foundation of Spartanburg will pay federal taxes on the raffle winnings at the time of the award and will pay to the IRS, on behalf of the winner, an amount equal to 33.33% of the cost of the motorcycle. The tax must be paid not only on the fair market value of the winnings, but also on the tax itself, therefore a grossed up tax rate of 33.33% of the winnings. This may or may not be the actual amount you will owe on your federal taxes. Please consult your tax advisor concerning your specific situation.

* Winner is required to pay state and local taxes, tag and title (as applied by the state of residence) on raffle winnings at the time of the award. The award is subject to all applicable federal, state, and local taxes.

The Music Foundation of Spartanburg Raffle of the Harley-Davidson Heritage Softail Classic Motorcycle is offered only in the United States and is open only to legal residents of the United States, 18 years of age or older at the time of entry. The raffle begins on February 24, 2017 and ends on or before April 24, 2017. The raffle is subject to all applicable federal, state, and local laws and regulations, and is void in Arkansas, Kansas, Hawaii, Utah and wherever prohibited or restricted by law.

The IRS now requires raffle winners to pay federal taxes on raffle winnings at the time of the award. The Music Foundation of Spartanburg will pay to the IRS, on behalf of the winner, an amount equal to 33.33% of our cost of the vehicle. The tax must be paid not only on the fair market value of the winnings, but also on the tax itself, therefore a grossed up tax rate of 33.33% of the winnings. This may or may not be the actual amount you will owe on your federal taxes. Please consult your tax advisor concerning your specific situation.  Winner is required to pay all state and local taxes, tag and title (as applied by state of residence of the winner) on raffle winnings at the time of the award.

 

How to Enter: 

To enter the raffle, please register online at www.spartanburgphilharmonic.org/motorcycle-raffle to purchase your ticket. Tickets are also available in person at Spartanburg Harley Davidson and the Spartanburg Philharmonic Orchestra Office. Tickets are $55 each. Online entries must be received by April 24, 2017 at 4:00pm.  For mail entry, please write your name, complete address, daytime telephone number and date of birth on a 3″x5″ card and mail in a business size #10 envelope with payment ($55.00 per ticket payable to Spartanburg Philharmonic Orchestra) to: The Music Foundation of Spartanburg, Attn: Motorcycle Raffle, 200 E. Saint John Street, Spartanburg SC 29306. Entries by mail must be postmarked by April 14, 2017 and received by April 21, 2017.  All entries become the sole property of The Music Foundation of Spartanburg and will not be returned. The Music Foundation of Spartanburg is not responsible for lost, stolen, illegible, incomplete, misdirected, late, damaged, destroyed, or delayed entries or postage due mail. Drawing:  The drawing will be held if 499 tickets are sold, which is the break-even point to cover the cost and taxes of the Raffle of the Red 2017 Harley-Davidson Heritage Softail Classic Motorcycle by The Music Foundation of Spartanburg. If at least 499 tickets are sold, a winner will be drawn at random on April 24, 2017. An independent accounting firm will supervise the entries and drawing.

 

Prize/Odds of Winning: Grand Prize: One (1) 2017 Harley-Davidson Softail Classic Motorcycle (“as is”). Approximate retail value $19,100.  Winner must claim prize within 30 business days of the drawing or a new winner will be selected.  Winner must provide valid driver’s license and evidence of legally required insurance at time of delivery. Winner is solely responsible for all other costs incurred in claiming, and using the motorcycle, including, without limitation, costs associated with state emissions standards compliance. All unspecified expenses are winner’s sole responsibility. No prize substitution or cash equivalent of prize except at the sole discretion of The Music Foundation of Spartanburg. No prize transfer.  A maximum of 999 tickets will be sold. Odds of winning are determined by the total number of entries received, with the maximum odds of 1:999. Each day entries received by mail and the Internet will be counted to determine if the total sold to date exceeds 999. All entries received the day on which 999 entries are received will be entered into a preliminary lottery. The first entries drawn from that group up to a total of 999 entries will be included in the final raffle. All other entries received that day (and thereafter) will be returned or refunded.

 

General Conditions: By entering, entrants accept and agree to the Official Rules and the decisions of The Music Foundation of Spartanburg, which are final and binding in all respects. If not present at the time of the draw, the Winner will be notified by telephone and by certified letter from The Music Foundation of Spartanburg and will be required to execute and return an affidavit of eligibility, a liability release and a publicity release, where legal, within 7 days of notification. In the event of non-compliance with requirements, or if prize notification is returned as undeliverable, prize will be forfeited and an alternate winner will be selected. By accepting the prize, except where prohibited by law, winner agrees to the use of his or her name and/or photograph for advertising/publicity purposes without further compensation or notice.  Raffle tickets are not deductible contributions to The Music Foundation of Spartanburg. By participating, entrant agrees to release and hold harmless The Music Foundation of Spartanburg, the directors, officers, agents and employees of such entity (collectively, the “released parties”) from any and all liability arising from participating in the raffle and/or acceptance, possession or use/misuse of prize, regardless of whether such claims are founded in whole or part upon alleged negligence, gross negligence or willful misconduct of any of the released parties. The Music Foundation of Spartanburg reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the raffle; to be in violation of the Official Rules, or to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any activities intended to disrupt or interfere with the proper play of the raffle or defraud The Music Foundation of Spartanburg in any way will be prosecuted to the fullest extent of the law.  The raffle is subject to all applicable laws of the United States.

 

Limitations of Liability: The Music Foundation of Spartanburg is not responsible for any incorrect or inaccurate information, including, without limitation, that which is caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the raffle or by any technical or human error which may occur in the processing of entries in the raffle. The Music Foundation of Spartanburg assumes no responsibilities for any error, omission, interruption, deletion, or defection, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of web site or entries in processing the raffle entries. The Music Foundation of Spartanburg is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of email or entrants on accounts of technical problems or traffic congestion on the Internet or at any web site associated with the raffle. The Music Foundation of Spartanburg is not responsible for user cheating or fraud by any entrants. If, for any reason, the raffle is not capable of running as planned, including, without limitation, unauthorized intervention, fraud, technical failures or any other causes beyond the control of The Music Foundation of Spartanburg which in, The Music Foundation of Spartanburg’s sole discretion could corrupt or affect the administration, security, fairness, integrity or proper conduct of the raffle, The Music Foundation of Spartanburg may, in its sole discretion, cancel the raffle and return/refund all entries or select the winner in a random drawing comprised of all eligible entries received prior to (and/or after, if appropriate) the action taken by The Music Foundation of Spartanburg. The Music Foundation of Spartanburg reserves the right at its sole discretion to cancel, terminate, modify or suspend the raffle.
